Statement of SERVIND s.r.o. on the protection of personal data

As for us, SERVIND s.r.o., with its registered office at Ke Kopanině 488, 252 67 Tuchoměřice, Business ID: 48024546, VAT ID: CZ48024546, a company registered in the Commercial Register kept by the Municipal Court in Prague under the registration number C 13943 (hereinafter also referred to as the "Controller“), the protection of your personal data is important, we will follow the below principles in order to achieve their highest possible protection.

This Statement and the subsequent processing of personal data is governed in particular by the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the personal data processing and on the free movement of such data (General Data Protection Regulation), (hereinafter referred to as "GDPR"). Cases that are not governed by the GDPR or expressly permitted to be regulated at national level are governed by the Act No. 101/2000 Coll. on the Personal Data Protection, as amended.

This statement may be amended by us at any time, particularly in the event of changes in the relevant legislation relating to data protection, so we recommend you that you in your own interest monitor our website for any updates to this statement.

When you make a purchase on our website or in our brick-and-mortar store, you provide us with your personal data within purchase agreements or other business relationships, so read below for more information about our processing of such data provided by you.

Please note that you do not have to provide us with your personal data, but if you do not provide us with some of the personal data we require, we will only be able to provide you with limited products or services.

First, we would like to explain some basic terms to help you better understand the following text of this Statement.

Personal data

"Personal data is any information about an identified or identifiable natural person (data subject). An identifiable natural person means a natural person, who can be identified, directly or indirectly, in particular by reference to an identifier (name, surname, number, network identifier) or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”

Data subject

"The data subject means a natural person, to whom the personal data relate and who is identifiable from the personal data."

Data controller

"The data controller is a natural or legal person who determines the purposes and means of the processing of personal data and is primarily responsible for the processing. Unless specified in this policy or in the terms and conditions of a particular service otherwise, the controller of personal data is (to be completed).”

Personal data processor

"A personal data processor is a natural or legal person who, on the instructions of the controller, processes personal data for the controller.”

Personal data processing

"Personal data processing means any operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automated processes, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other disclosure, alignment or combination, restriction, erasure or destruction.”

How we process data

We process the personal data provided by you on the basis of a lawful reason according to Article 6 GDPR paragraph 1 (b), in particular, if the processing is necessary for the performance of a contract or according to (c) for the fulfilment of a legal obligation. In addition, also according to clause a) on the basis of your provided consent to the processing of these data in the event that the legitimate interests according to the above provision are not sufficient as a lawful ground for processing.

Personal data is processed for the purposes of order processing, conclusion of purchase agreements, delivery of ordered goods, complaint procedures and for direct marketing purposes (see the Commercial Communication).

We only ever use the personal data you provide for the purpose, for which the data was provided to us and we always inform the user of this purpose in a transparent manner.


What data we process

We collect the following personal data in the context of our business relationships:

g) credit card details (provided you have used one)


(h) professional details in case of job applicants

Personal data retention period

We retain data for the period necessary for the purposes of performance under the agreement and for the period necessary to comply with legal obligations or to protect our rights. Data provided on a basis of the data subject's consent will be kept for the period specified in the consent. If you exercise your right to be forgotten or withdraw the given consent, the data will of course be retained for a shorter period.

Data submission – other processors

The controller is entitled to process personal data both automatically and manually, also through designated processors. Personal data is/will only be disclosed to authorised employees of the Controller or employees of the processor, only to the extent necessary for the purposes of the processing. A transfer of personal data to other processors only occurs rarely and all processing relationships are based on processing agreements, in which our processors have guaranteed to take measures to ensure the same level of security of personal data as provided by our company.

Business Communications

According to Section 7 (3) of the Act No. 480/2004 Coll., on Certain Information Society Services and on Amendments to Certain Acts (Act on Certain Information Society Services), as amended, we are allowed to use the data provided by your for direct marketing within the framework of our existing contractual relationship. These marketing communications will only relate to our similar products and services. At the same time, in each such marketing communication you will find an option to unsubscribe from these communications free of charge.

Cookies

Our website www.servind.cz uses text cookies to make our offer relevant to you. They are used to remember your preferences and the actions you have taken on the website (e.g. login details, language, font size and other display preferences). Consequently, you do not need to re-enter this information for a certain period of time. Our cookies themselves do not identify an individual user, they only identify the device you are using, using a randomly generated identification code. As a user, you are free to disable or restrict the use of cookies in your browser. Nevertheless, if you do so, you will not be able to use all the features offered by our site.

Security

We use certain technologies and security features to achieve the highest possible level of protection for the personal information provided by you. While we make every effort to protect your personal information from loss, misuse, unauthorized access, alteration or disclosure, it is never possible to ensure 100% control. Therefore, we will notify you immediately in the event of any incidents reaching a certain level of risk.


Rights of data subjects

In order to honour the principle of transparency in the processing of personal data, we are happy to provide you with information on what personal data we process about you using the contact details below.
If legally acceptable, you have the right to amend or correct the personal data we hold about you.
If the processing of your personal data is based on your consent, you have the right to restrict this processing, withdraw your consent or even have all the data we hold based on your consent deleted. The exceptions to this are where the processing is carried out because of a legal obligation or because of our legitimate interest.
You are also entitled to copy the personal data we hold about you, including its sources, purposes and methods of processing, electronic decision-making and the parties with whom we share your data. We will strive to make the information you request available to you within a reasonable time. Depending on what information you request, we may charge you a small fee to the extent permitted by applicable law.
If you believe that the Controller is processing your personal data in breach of the GDPR, you are entitled to object to the processing and also have the right to lodge a complaint with the Data Protection Authority.
